Penalties for driving under the influence of alcohol
Driving under the influence of alcohol still results in many fatalities on the roads every year. In 2005 the penalties for driving under the influence of alcohol were increased.
The first time you drive under the influence of alcohol
-
Your driving licence is suspended
0.51 - 1.2 parts per thousand: Suspended licence /new motorist: driving prohibition.
Over 1.2 parts per thousand: Unconditional suspension for at least 3 years.
-
You get a fine
0.51 - 2.0 parts per thousand: Fine = net monthly income x alcohol concentration (ppt).
Example: Monthly salary paid out: 15000 kr. Alcohol concentration: 0.6 ppt. Fine: 9000 kr.
Over 2.0 ppt: 20 days suspended prison plus a fine equal to one month's net income.
- You have to attend an Alcohol and Traffic Course
An obligatory Course at your own expense. It involves 4 x 2½ hours and costs about 2000 kr.
If you drive under the influence of alcohol several times, the penalties are higher
You will get a suspended prison sentence the second time, and an unconditional prison sentence the third time.
What is conditional and unconditional suspension?
Conditional suspension:
You keep your driving licence if you pass a driving test (i.e. a theory test and a practical driving test) within three months. If you fail one of the tests, you must surrender your licence, and you will get it back when you have passed both tests. With a conditional suspension, you are "on probation" for three years.
Unconditional suspension:
You must surrender your licence and lose the right to drive a vehicle for a period of at least three years. You must then pass a theory test and a practical test. When you have got your licence back, you will be "on probation" for a period (e.g. five years).
What does probation mean?
If you violate the Traffic Regulations in your probation period in a way that normally results in conditional suspension of your driving licence, your licence will be suspended unconditionally for at least six months.
The penalties are higher for new motorists
If you received your first driving licence less than three years ago, the regulations are stricter for you.
If you drive with a concentration of alcohol in your blood from 0.51 to 1.2 parts per thousand, you can no longer drive and must surrender your licence. You must attend an Alcohol and Traffic Course and pass a test before you can drive again.
